Why is the HOA proposing this?

West Park Estates is a well-established residential community, and our governing documents reflect the importance of maintaining the neighborhood’s residential character, appearance, and quality of life.

As the nature of residential rentals continues to change, the Board believes it is appropriate to further define and strengthen the community’s standards regarding rental use. The proposed amendment would establish a minimum rental term, helping ensure that homes within West Park Estates remain part of a stable residential community rather than being used for transient or vacation accommodations.

The proposed amendment is intended to provide homeowners with a clear, consistent standard for rental use while preserving the residential character and long-term stability of West Park Estates.

This is a proposal — homeowner input is important

The Board is proposing a minimum rental term, but the specific period has not yet been determined. We want to hear from homeowners about what minimum rental period best serves the long-term interests of our community.

Homeowners are encouraged to consider what minimum rental period they believe would best serve the long-term interests of our community: __________.

Homeowner participation is especially important

This proposal would amend the Declaration of Protective Covenants and requires approval from at least three-fourths of the restricted lots — 57 of the 76 homes in West Park Estates.

That means participation from homeowners who cannot attend the meeting is especially important. If you cannot attend the October 6, 2026 Annual Homeowners Meeting, please consider completing the 2026 Annual Meeting Proxy Form available on the HOA website.

A proxy allows another person to represent you and vote on your behalf at the meeting.

Whether you support, oppose, or have questions about the proposal, please make sure your position is represented by attending the meeting or submitting a proxy.

October 6, 2026 Annual Homeowners Meeting

The proposed restriction will be discussed at the Annual Homeowners Meeting. The minimum rental period and other provisions may be discussed and revised based on homeowner input before the amendment is finalized.

If the required approval is obtained, the HOA will finalize the amendment, obtain any necessary legal review, and take the steps necessary to properly execute and record the amendment with Williamson County. The restriction will not become effective until the amendment has been properly approved and recorded.


PROPOSED AMENDMENT TO THE DECLARATION OF PROTECTIVE COVENANTS

Section __. Short-Term Rental Restriction

1. Minimum Rental Term

No Lot, or any portion thereof, may be leased, rented, or otherwise made available for occupancy for a term of less than __________ consecutive days.

2. Rental Definition

For purposes of this Section, a “lease” or “rental” means any written or oral agreement under which the right to occupy or use all or part of a dwelling on a Lot is granted in exchange for consideration, whether monetary or otherwise. This includes, without limitation, arrangements made through online or app-based platforms such as Airbnb, VRBO, HomeAway, or similar services.

3. Prohibition of Short-Term Rental Advertising

No Owner may advertise, list, or otherwise offer a Lot for transient, vacation, or short-term rental use for a period of less than __________ consecutive days. Advertising or listing a Lot for a rental period of less than the minimum rental term established by this Section shall constitute evidence of a violation of this Section.

4. Owner Responsibility

The Owner remains responsible for compliance by tenants, occupants, and guests with the Declaration, Bylaws, and duly adopted Association rules. A violation by a tenant, occupant, or guest shall constitute a violation by the Owner.

5. Enforcement

Violations of this Section shall be subject to the enforcement remedies available to the Association under the Declaration, Bylaws, applicable Association rules, and Texas law.

6. Existing Leases

A valid written lease that was in effect before the effective date of this Amendment may continue until its stated expiration date. Such lease may not thereafter be renewed or extended in violation of this Section.
