Community Standards and Policy Update

Dear Homeowners,

At our annual homeowners meeting held on October 7, 2025, several recurring issues were discussed that affect the appearance, safety, and property values of our community. This letter outlines those concerns, cites the applicable sections of our governing documents, and provides notice that the HOA will begin consistent enforcement of these provisions.


1. LEASED OR RENTAL PROPERTIES

Concern: Some homes are being leased or rented without the HOA receiving required information from the owner.

Governing Reference: Declaration, Article 18 – Maintenance Association and Maintenance Charge:

“In the event a member sells, leases or rents his/her lot within the subdivision, the member must give notice within five (5) days of the date of sale or commencement of lease or rental term to the Association…”

Action:

  • Homeowners who lease their property must complete the Rental Property Information Form.
  • NOTE: At the October 2025 meeting, the HOA Board voted to consult an attorney on potentially amending the governing documents to prohibit short-term rentals, including those offered through VRBO and Airbnb. Until any such amendment is adopted, only rentals and leases that comply with our current bylaws and Declaration are permitted. The Board and homeowners have expressed a strong interest in maintaining a stable residential neighborhood and do not wish to see any short-term rentals in our community.

2. FENCE MAINTENANCE

Concern: Several fences throughout the community are in visible disrepair.

Governing Reference: Declaration, Article 12 – Fences, Walls, and Hedges:

“The obligation to maintain, repair, and replace fences or walls shall be appurtenant to the ownership of the lots and shall be a covenant running with the land.”

Clarification: Each homeowner owns and is responsible for the fence located on their property. If the structural posts or rails face your lot’s interior, that side is generally your responsibility.

Action:

  • Inspect fencing and make necessary repairs to maintain a uniform, attractive neighborhood appearance.

3. VEHICLES, EQUIPMENT, TRAILERS, AND BOATS

Concern: Several properties have boats or large trailers stored long-term in driveways, side yards, or visible from the street. These items create a cluttered appearance and are not consistent with community standards.

Clarification: Normal, everyday parking of passenger vehicles cars, SUVs, and pickup trucks that are in regular use is fully permitted. Restrictions apply to boats, trailers, oversized vehicles, and large equipment that remain parked or stored for extended periods, whether on the lot or on the adjoining street.

Governing Reference: Declaration, Article 16 – Miscellaneous Vehicles and Equipment:

“No automobile, truck, camper, motor home, mobile home, boat or other vehicle, trailer, machinery or equipment of any kind shall ever be parked on any lot or on any street right-of-way… except for temporary parking incident to contemporaneous use.” “No vehicle of height greater than nine (9) feet shall be kept or stored on any lot or on the street adjoining any lot or common area.”

Action: On your property (driveways and yards):

  • Boats, trailers, or other large equipment may not be stored long-term in driveways or other visible areas.
  • Short-term parking is allowed only while actively loading, unloading, or preparing for use.
  • All vehicles kept on a lot must be operable, properly registered, and within the nine-foot height limit.

On public streets:

  • The City of Cedar Park prohibits large vehicles, campers, motor homes, mobile homes, boats, trailers, machinery, or similar equipment from being parked on public streets.
  • Vehicles in violation are subject to city citation or towing under local ordinance.

4. PROPERTY APPEARANCE AND TRASH

Concern: Some lots have accumulated clutter, construction materials, or debris.

Governing Reference: Declaration, Article 7 – Prohibited Activities:

“No lot shall be used in whole or in part for the storage of rubbish, debris, junk, or other unsightly materials, and no portion of any lot shall be used in any manner which may become an annoyance or nuisance to the neighborhood.”

Action:

  • Maintain visible areas of your property in a clean, orderly condition to preserve neighborhood appearance.

5. PET WASTE AND GREENBELT AREAS

Concern: Complaints have been received regarding homeowners throwing dog waste over their back fences into the community greenbelt – creating strong odors and unsanitary conditions.

Governing References:

  • Article 10- Animals: “Owners of pets must promptly remove the excrement of their pets from all streets, sidewalks, yards and other areas within the subdivision.”
  • Article 7-Prohibited Activities: “No portion of any lot shall be used in any manner which may become an annoyance or nuisance to the neighborhood.”

Action:

  • Disposing of pet waste in the greenbelt or any shared area is a violation of HOA rules and may be subject to City of Cedar Park sanitation enforcement.
  • Homeowners must bag and dispose of pet waste properly in their own trash containers.

6. TRASH AND WASTE CONTAINERS

Concern: Trash cans are being left visible from the street after collection days.

Governing Reference: Declaration, Article 9 – Garbage and Other Waste:

“All such waste substances being kept on a lot pending collection thereof shall be kept in closed sanitary containers with tops or lids… Any such containers shall be hidden from general view…”

Action:

  • Trash day is Wednesday.
  • Containers may be placed out the evening before collection and should be removed by that evening.
  • Store bins out of sight from the street when not in use.

7. EXTERIOR PAINT, MATERIALS, AND ARCHITECTURAL CHANGES

Concern: Exterior modifications including painting, siding, brickwork, or structural changes must be reviewed for neighborhood consistency prior to work.

Governing Reference: Declaration, Article 2 – Architectural Control:

“No building, structure or improvement of any character shall be erected, placed, added to or altered on any lot… until the building plans, specifications and a site plan… have been submitted to and approved by the Architectural Control Committee.”

Action:

8. DELINQUENT DUES AND LONG-TERM NONPAYMENT

Concern: A few properties have remained delinquent for many years, creating an unfair burden on other homeowners.

Governing Reference: Declaration, Article 18-Maintenance Association and Maintenance Charge:

“Any maintenance charge assessed hereunder and not paid when due shall bear interest from the date due until paid at the rate of ten percent (10%) per annum.” “A lien is hereby established on the lots… to secure payment of the maintenance charge together with all reasonable expenses, costs, and attorney’s fees incurred in collection.”

Clarification: The Board understands short-term delinquencies may occur. However, long-term nonpayment will be addressed per governing documents. The HOA will continue to work with homeowners who communicate and make good-faith efforts to stay current.

9. FINES AND ENFORCEMENT POLICY (IN DEVELOPMENT)

Status: The Bylaws authorize the HOA to adopt and publish rules and establish penalties for infractions (Bylaws, Article VII, Section 1[a]).

Next Steps: A draft Fines & Enforcement Policy will be circulated for homeowner feedback before adoption.


COMPLIANCE PERIOD, SUMMARY, AND CONTACT

The HOA understands that many issues take time to address. Our goal is collaboration, not confrontation. Board members may contact homeowners directly or by letter to clarify specific concerns. A grace period will be provided to make improvements before formal enforcement begins.

Formal enforcement and fines will begin June 1, 2026.

Our collective goal is to maintain property values, ensure fairness, and preserve neighborhood appeal. Thank you for your cooperation and continued participation.
